General Terms and Conditions of Sale

1. Orders

All placed orders are binding. These general terms and conditions apply from the moment we receive your order by email.

All orders are subject to the sales conditions described below.

Any deviation must be reported in writing and explicitly accepted by B.Custom VAT BE-0653.901.150.

All prices listed on the website are subject to change. We are not obliged to deliver products if prices were listed incorrectly. You will be notified as soon as possible if an incorrect price has been displayed. Products will be delivered at the prices valid on the date of the order.

All customer prices of B.Custom for private individuals include Belgian VAT and exclude possible shipping costs.

All offers published on the B.Custom website remain valid as long as they are displayed on the website and may be modified at any time for operational reasons. All offers remain valid while supplies last. B.Custom reserves the right to adjust prices in offers.

All images, drawings, specifications concerning weight, dimensions, colours, etc., contained in brochures or on the website are approximate only and cannot give rise to compensation or cancellation.

No rights can be derived from the images displayed on the B.Custom website. Images are intended to provide an impression of the products and may differ from the actual product.

B.Custom reserves the right to refuse orders without providing reasons, or to accept them only after payment of an advance deposit, in which case the buyer will be informed accordingly.

1.1 Unless explicitly stated otherwise, every order implies the customer’s acceptance of these terms and conditions and the rejection of the customer's own purchase or sales conditions.

1.2 The fact that the buyer may not have received these general terms and conditions in their native language does not exempt them from their application.

1.3 All clauses shall be interpreted in favour of B.Custom, the seller.

1.4 The term seller refers to B.Custom; the term buyer refers to the customer.

1.5 Any dispute that may arise between the parties shall be settled exclusively by the competent courts under Belgian law, applicable to both national and international transactions.

1.6 Exclusion of any other liability: all claims by the buyer that are not expressly mentioned in these sales conditions are excluded, regardless of their legal basis, in particular any claims for compensation.

 

 

 

 

2. Delivery Time

The agreed delivery time is only indicative and not binding. The buyer cannot claim any compensation, nor demand cancellation or termination of the agreement if the delivery deadlines are not respected.

Delivery of Maxton Design products takes approximately two weeks up to a maximum of two months after ordering. This also applies to custom-made products such as wheels with custom PCD, ET values, or other custom-made items.

2.1 The seller has the right to extend delivery times or terminate the agreement in case of force majeure or operational disruptions of any nature occurring at the seller, its suppliers, or third parties, including late or defective delivery of raw materials, semi-finished products or components, unavailability of essential parts, or official regulations.

2.3 The seller is entitled to make partial deliveries.

2.4 Goods are always transported at the buyer’s risk and responsibility, regardless of the party performing the transport or the party on whose behalf it is carried out. Additional costs for express shipping are always borne by the buyer.

3. Payment

3.1 As a general rule, invoices must be paid within 7 days of the invoice date, and all payments must be completed before collection unless otherwise agreed in writing.

Payment can be made by bank transfer to the account of B.Custom or upon collection (cash or digital payment).

Goods will only be shipped after the full amount including shipping costs has been paid.

If the buyer refuses the products or fails to collect them within two weeks from the designated storage location, the seller is entitled to invoice the buyer for the costs incurred, including transport, administrative costs, and depreciation.

These costs amount to 15% of the principal amount with a minimum of €100.

The buyer is responsible for the correct receipt of the goods.

 

3.2 To be valid, any complaint must be submitted within 8 calendar days after delivery by registered letter; otherwise it will be considered null and void.

 

3.3 If the seller sends an invoice, payment must be made within 7 days unless agreed otherwise in writing.

If payment is not made on time:

a first reminder will be sent free of charge;

if payment is still not received within the specified period, late payment interest will be charged in accordance with the Belgian Law of 2 August 2002 on combating late payment in commercial transactions, together with a fixed compensation fee:

€20 if the outstanding balance is ≤ €150

€30 + 10% of the amount between €150.01 and €500

€65 + 5% of the amount above €500 (maximum €2000)

Administrative costs for each additional reminder amount to €7.50 plus applicable postage costs.

3.4 The buyer has no right to delay payment or apply deductions due to complaints, claims or compensation demands not recognized by the seller.

3.5 The seller retains ownership of the goods until full payment of the principal, interest and possible compensation has been made. The buyer authorizes the seller to recover the delivered goods at any time wherever they may be located.

4. Repairs and Warranty

The seller guarantees the quality of services performed and the proper quality of delivered products within the limits described below.

4.1 Defective goods returned for repair without a clear description of the defect will be returned in the same condition to the buyer.

Transport and return costs are always borne by the buyer.

Products sent for repair must arrive in the original packaging or otherwise in proper protective packaging.

Modified, installed, or custom-made products cannot be returned.

 

4.2 If goods show transport damage upon arrival, they will be returned to the buyer at the buyer’s expense and will not qualify for replacement.

Additional provisions apply regarding repair inspection costs and storage risks.

4.3 A 12-month warranty applies to delivered products unless the manufacturer provides a different warranty period.

4.4 Damage caused by improper installation, overvoltage, moisture or incorrect use is not covered by warranty.

4.5 Repairs do not create a new warranty unless expressly agreed.

4.6 Warranty procedure:

The product will be sent to the supplier who decides whether the warranty applies. If not, the costs will be charged to the buyer.

4.7 For skid plates / engine protection plates, B.Custom provides no warranty for possible damage to the engine or vehicle chassis. Such damage is usually caused by incorrect installation, improper use, or insufficient ground clearance.

4.8 Customer supplied materials remain entirely at the customer's risk. In case of production errors the customer must supply replacement materials.

4.9 Custom exhaust systems are considered custom-made products and cannot be returned. These products are intended for classic cars or track use only and may not comply with road regulations.

4.10 Wheels

Wheel sizes must be verified by the buyer.

Custom wheels, wheels drilled to a specific bolt pattern, mounted wheels or tyres, damaged wheels, or individually ordered wheels cannot be returned.

Older or discontinued models cannot be returned as they cannot be resold as a set.

4.11 Tyres

Tyre sizes must be verified by the buyer. Non-standard tyre sizes ordered at the buyer’s request are the buyer’s full responsibility and cannot be returned unless agreed otherwise.

4.12 3D Custom Products

All 3D printed custom products are manufactured according to parameters agreed with the customer (material, density, properties). Any resulting defects are a consequence of these choices and therefore not covered by warranty unless agreed otherwise.

5. Returns for Distance Sales

5.1

Customers have the right to return items within 14 days after receipt.

The return must first be announced by email to info@b-custom.com

Returned goods must be in original condition and packaging.

Products that show damage, dirt, installation marks, or signs of use will not be accepted.

Return shipping costs are borne by the buyer.

Returned goods will only be refunded as store credit if the reason for return is not valid.

5.3 Single items, specially ordered goods, discontinued models, or products that cannot be resold as a set are not eligible for return.

5.4 To prevent abuse, B.Custom reserves the right to refuse refunds if the return policy is used improperly.

5.6 Once the return has been received and inspected, we will either send a replacement product or refund the purchase price if the fault lies with B.Custom.

Custom products are excluded from the right of withdrawal.

6. Shipping Responsibility

The responsibility for shipped goods lies with the carrier and the sender.

The recipient must inspect the goods immediately upon delivery.

If damage to packaging or goods is detected, the buyer must report this at the moment of acceptance.

If the goods are accepted without remarks, neither the seller nor the carrier can be held responsible for damage.

7. Liability

The seller accepts no liability for damage to other equipment belonging to the buyer or third parties caused by a defective product.

The seller is not liable for damage resulting from incorrect installation, improper handling, misuse, or use outside the product specifications.

 

8. Force Majeure

If the seller cannot fulfil obligations due to force majeure, performance will be suspended for the duration of the force majeure situation.

If the situation lasts more than one month, both parties may terminate the agreement in writing.

The buyer has no right to compensation in case of force majeure.

9. Termination

If the buyer fails to fulfil obligations, files for bankruptcy, or ceases business operations, all claims by the seller become immediately due and payable without formal notice.

The seller may suspend performance or terminate the agreement and reclaim delivered products.

10. Disputes

All agreements with B.Custom are governed exclusively by Belgian law.

In case of disputes, the courts of the district of Hasselt (Belgium) have exclusive jurisdiction.

Copying or reproducing products, designs, or drawings from B.Custom is prohibited under the Belgian Copyright Act of 30 June 1994.

Paid deposits are non-refundable.

 

11. Buyer Default

If the buyer fails to comply with obligations, B.Custom may suspend deliveries.

If the buyer does not respond within 10 days after formal notice, the agreement may be considered terminated.

B.Custom is entitled to 35% compensation of the invoice amount for costs and loss of profit.

Late payments automatically incur 8% annual interest plus a 10% penalty clause with a minimum of €75.

Appointments must be cancelled at least 24 hours in advance, otherwise a minimum charge of €80 will apply.

Placing an order implies that the customer has read and accepted these conditions.

Any payment made to B.Custom constitutes acceptance of these general terms and conditions of sale.
