Terms and Conditions of Sale

1. General Terms

1.1 All orders are subject to the following terms and conditions of sale. Once an order is placed, it becomes binding. These terms apply as soon as we receive your order via email.

1.2 Any deviation from these terms must be communicated in writing and expressly accepted by B.Custom (VAT-BE-0653.901.150).

1.3 Prices listed on the website are subject to change. We are not obligated to deliver products at incorrect prices. If a pricing error occurs, you will be informed promptly. Products will be delivered at the prices valid on the order date.

1.4 All listed prices for private customers include Belgian VAT but exclude shipping costs.

1.5 All offers displayed on the B.Custom website are valid as long as they remain visible and available. These offers may be changed at any time for operational reasons. Prices for promotions are subject to modification.

1.6 Images, drawings, weights, dimensions, and colors shown in brochures or on the website are approximate and cannot be the basis for compensation claims or contract cancellation.

1.7 Images displayed on the website are for illustrative purposes only and may differ from the actual products.

1.8 B.Custom reserves the right to refuse orders or accept them only after receiving a deposit. The customer will be informed accordingly.

2. Delivery Terms

2.1 Agreed delivery times are indicative and not binding. Delayed deliveries do not entitle the customer to compensation or cancellation of the order.

2.2 Delivery times for Maxtondesign products are approximately two weeks to two months. Custom-made products, such as wheels with custom PCD or ET values, follow the same timeline.

2.3 In cases of force majeure or operational disruptions (e.g., supply chain issues or raw material shortages), delivery times may be extended or canceled.

2.4 Partial deliveries are allowed.

2.5 Goods are shipped at the customer's risk, regardless of the transporter or shipping arrangements. Costs for expedited shipping are also the customer’s responsibility.

3. Payment

3.1 Invoices must be paid within seven days of the invoice date unless otherwise agreed. Payment methods include prepayment via bank transfer or direct payment (cash or digital). Goods are shipped only after full payment, including shipping fees.

3.2 In case of non-collection within two weeks, B.Custom reserves the right to invoice the customer for incurred costs, including transport and administrative fees (minimum €100 or 15% of the invoice total).

3.3 Late payments will incur interest as per the Belgian Law of August 2, 2002 on combating late payments, along with the following charges:

  • €20 for amounts ≤ €150.
  • €30 + 10% for amounts between €150.01 and €500.
  • €65 + 5% for amounts > €500 (up to a maximum of €2,000).

4. Warranty

4.1 A 12-month warranty is provided unless the manufacturer specifies otherwise. The warranty does not cover defects caused by improper installation or use.

4.2 Modified, custom-made, or installed products are not eligible for return.

4.3 Any warranty claims will be assessed by the supplier. If a claim is denied, the associated costs will be borne by the customer.

5. Returns

5.1 Customers have the right to return items within 14 days of receipt. Returns must be communicated via email and include the original packaging.

5.2 Return shipping costs are the customer’s responsibility. Goods showing signs of use or damage cannot be returned. Refunds are issued as store credit only.

6. Shipping

6.1 Responsibility for goods lies with the carrier and sender. Customers must inspect products upon receipt and report damages immediately.

6.2 Returned items must be sent in their original packaging, and all shipping costs are the customer’s responsibility.

7. Liability

7.1 B.Custom is not liable for damages to other equipment or third parties caused by defects in delivered products.

7.2 Improper use, handling, or installation voids any liability on the seller's part.

8. Force Majeure

8.1 In cases of force majeure, obligations are suspended for the duration of the event. If the force majeure lasts for more than one month, both parties may terminate the agreement.

8.2 No compensation is owed in cases of force majeure.

9. Termination of Agreement

9.1 If the buyer fails to meet obligations (e.g., payment default, bankruptcy, or liquidation), B.Custom reserves the right to terminate the agreement immediately.

9.2 In such cases, B.Custom may demand compensation and recover delivered products at the buyer's expense.

By placing an order with B.Custom, you confirm that you have read and agreed to these terms and conditions. Every payment made constitutes acceptance of these terms.
